Terms of Service

Template — this page ships as a working starting point for AgencyBrain's actual Terms of Service. It has not been reviewed by a lawyer and should not be treated as final before real customers sign up on it.

1. Agreement to Terms

These Terms of Service ("Terms") govern access to and use of AgencyBrain (the "Service"), operated by Wahsol Technologies ("we", "us", "our"). By creating an account or using the Service, you agree to be bound by these Terms on behalf of yourself and, if applicable, the organization you represent.

2. The Service

AgencyBrain is a marketing operations platform providing SEO, content, and social-media tooling, including AI-assisted content generation via third-party AI providers (currently Anthropic and Google). Features available to your account depend on your subscription plan.

3. Accounts

• You are responsible for safeguarding your account credentials, including enabling two-factor authentication where available.
• You must provide accurate information when creating an account or organization.
• One account may belong to multiple organizations ("tenants"); billing and data are scoped per-organization.

4. Subscriptions & Billing

• Paid plans are billed in advance on a monthly or annual basis via Stripe.
• Plan changes (upgrade/downgrade) prorate automatically through Stripe.
• Failed payments trigger a grace period before the account is downgraded — see your billing settings for the exact grace window.
• Fees are non-refundable except where required by law.

5. AI-Generated Content

The Service uses third-party large language models to draft content, suggestions, and analysis on your behalf. AI output may be inaccurate or require review — you are responsible for reviewing and approving any AI-generated content before publishing it externally. We do not warrant the accuracy, originality, or fitness for any particular purpose of AI-generated output.

6. Acceptable Use

You agree not to use the Service to:

• Violate any applicable law or the rights of any third party;
• Generate or publish unlawful, defamatory, or infringing content;
• Attempt to access another organization's data without authorization;
• Probe, scan, or attempt to bypass the Service's security or rate limits;
• Resell or white-label the Service beyond what your plan explicitly permits.

7. Your Data

You retain ownership of the content, keywords, and other data you or your team enter into the Service. We process it as described in our Privacy Policy. You may export or permanently delete your organization's data at any time from Settings → Data & Privacy.

8. Termination

You may cancel your subscription or delete your organization's account at any time. We may suspend or terminate accounts that violate these Terms, with notice where reasonably possible.

9. Disclaimers & Limitation of Liability

The Service is provided "as is" without warranties of any kind. To the maximum extent permitted by law, we are not liable for indirect, incidental, or consequential damages arising from use of the Service, including reliance on AI-generated content or rankings/performance outcomes.

10. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated via email or an in-app notice. Continued use of the Service after changes take effect constitutes acceptance.
